2. Eligibility Requirements
To use Roots, you must:
Age Requirement
- Be at least 21 years of age (or the legal age for cannabis in your jurisdiction) - Provide valid government-issued identification - Pass our age verification process
Location
- Be located in a state/jurisdiction where cannabis is legal - Access Services from an address where delivery is permitted
Legal Compliance
- Comply with all applicable federal, state, and local laws - Not be prohibited from purchasing cannabis products
We reserve the right to refuse service to anyone who does not meet these requirements.
3. Account Terms
Account Creation
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
Account Security
- You are responsible for all activities under your account - Notify us immediately of any unauthorized access - Do not share your login credentials
Account Termination
We may suspend or terminate your account for: - Violation of these Terms - Fraudulent activity - Providing false information - Legal requirements
4. Ordering & Purchasing
Order Acceptance
All orders are subject to acceptance. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing, or identification issues.
Pricing
- All prices are shown in USD and include applicable taxes - Prices may vary by dispensary - We reserve the right to correct pricing errors
Product Availability
- Products are subject to availability - Substitutions may occur with your approval - We do not guarantee specific product availability
Order Cancellation
- You may cancel within 5 minutes of placing an order - Cancellations after preparation begins may incur fees - Refunds are processed according to our refund policy
5. Delivery Terms
Delivery Requirements
- Delivery address must be a private residence - You must be present to receive delivery - Valid ID matching the order must be presented - You must appear sober at delivery
Delivery Acceptance
By accepting delivery, you confirm: - You are 21+ years old - The products are for personal use - You will not resell or redistribute
Failed Deliveries
Failed deliveries due to unavailability, invalid ID, or other customer-related issues may result in: - Redelivery fees - Order cancellation - Restocking fees
6. Payment Terms

- Debit cards - Credit cards (where permitted) - ACH bank transfers - Cash on delivery
Payment Authorization
By providing payment information, you authorize us to charge the applicable fees. Payment is due at the time of order.
Refunds

7. Product Information

Third-Party Products
Products are manufactured and sold by licensed dispensaries. We are a technology platform connecting consumers with dispensaries.
Product Use
- Products are for personal use only - Follow all product instructions and warnings - Consult a healthcare provider for medical questions - Do not operate vehicles or machinery while impaired
8. Prohibited Activities
You agree NOT to:
- Provide false or misleading information
- Use Services for illegal purposes
- Resell or redistribute products
- Share your account credentials
- Circumvent age verification
- Engage in fraudulent activity
- Interfere with Services operation
- Scrape or data mine our platform
- Violate others' intellectual property
- Harass staff, drivers, or other users
9. Intellectual Property
Ownership
The Roots platform, including all content, features, and functionality, is owned by Roots and protected by intellectual property laws.
License
We grant you a limited, non-exclusive, non-transferable license to use our Services for personal, non-commercial purposes.
Restrictions
You may not: - Copy, modify, or distribute our content - Use our trademarks without permission - Reverse engineer our technology - Remove copyright notices
10. Disclaimers
Service Availability
Services are provided "as is" and "as available" without warranties of any kind.
Product Liability
We are a technology platform. Product liability rests with the licensed dispensaries and manufacturers.
Health Disclaimers
- Cannabis affects individuals differently - Consult healthcare providers before use - Products are not FDA-approved - We make no medical claims
No Warranties
We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
11. Limitation of Liability
Liability Cap
To the maximum extent permitted by law, Roots' total liability shall not exceed the amount you paid for the specific order giving rise to the claim.
Exclusions
We are not liable for: - Indirect, incidental, or consequential damages - Loss of profits or data - Product effects or reactions - Third-party actions
Exceptions
Some jurisdictions do not allow limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Roots, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of Services
- Your violation of these Terms
- Your violation of any laws
- Your violation of third-party rights
- Products purchased through our platform
13. Dispute Resolution
Arbitration Agreement
You agree that any dispute arising from these Terms or Services shall be resolved through binding arbitration, not in court.
Class Action Waiver
You waive any right to participate in a class action lawsuit or class-wide arbitration.
